Terms of Use
These general terms and conditions define the applicable rights and obligations within the framework of the online sale of goods and services offered by CARCER.
Purpose
These general terms and conditions define the rights and obligations of the parties in connection with the online sale of goods, hereinafter referred to as the "Goods," and services offered by CARCER to the Buyer, hereinafter referred to as the "Buyer."
All orders imply the Buyer's unreserved acceptance of these General Terms and Conditions of Sale, which prevail over any other document, including, in particular, any conflicting stipulation on a purchase order or other document issued by the Buyer. These terms and conditions, together with the purchase order and, where applicable, any other agreement between CARCER and the Buyer, constitute the "Contract" for the purposes hereof.
Any order implies the Buyer's unreserved acceptance of these General Terms and Conditions of Sale, which prevail over any other document, including, in particular, any conflicting stipulation on a purchase order or other document issued by the Buyer.
These terms and conditions, together with the purchase order and, where applicable, any other agreement between CARCER and the Buyer, constitute the "Contract" for the purposes hereof.
Order
The Buyer places their order online after consulting the catalog provided.
For the order to be validated, the Buyer must accept these terms and conditions by clicking in the designated area on the website. They must also choose the delivery address and method , the billing address, confirm the payment method, and pay online.
The order will be confirmed by email no later than the time of delivery.
All orders constitute acceptance of the prices and descriptions of the Goods available for sale.
In the event that the Goods are unavailable, the Buyer will be informed as soon as possible and will have the option to cancel their order. The Buyer will then have the choice of requesting either a refund of the sums paid within 30 days of payment, or an exchange of the product.

Prices
CARCER reserves the right to modify its prices at any time, but undertakes to apply the prices in effect at the time of the order, subject to availability on that date.
Prices are indicated in euros. They do not include delivery charges, which are billed separately and indicated before order confirmation. Prices include VAT applicable on the day of the order. Any change in the applicable VAT rate will be automatically reflected in the price of products in the online store.
Full payment is due at the time of order. Under no circumstances will payments be considered as deposits or down payments.
Payment Methods
To pay for their order, the Buyer may choose from all payment methods made available by CARCER, namely: Visa, Mastercard, CB, and PayPal.
The Buyer guarantees to CARCER that they have all necessary authorizations to use the payment method chosen when validating the order form.
Delivery and Receipt of Goods
No deliveries are made to campsites, hotels, poste restante addresses, or P.O. boxes. Goods are delivered to the address indicated by the Buyer on the order form, which the Buyer is responsible for ensuring is accurate. Any package returned to CARCER due to an incorrect or incomplete delivery address will be reshipped at the Buyer's expense.
In the event of damage or non-conformity of the delivered Goods, it is the Buyer's responsibility to make all necessary reservations within 20 days of receipt, by email to the following address: contact@ikaoparis.com, or in writing to CARCER at the following address: CARCER Ikao lot n°142, 8 rue des Gardinoux, 93300 Aubervilliers, France. Otherwise, the Goods will be deemed to have been accepted in conformity and in perfect condition.
Buyers wishing to return Goods for an exchange or refund must send them within 20 days of delivery to the following address: CARCER Ikao lot n°142, 8 rue des Gardinoux, 93300 Aubervilliers, France. The goods must be unworn, unwashed, and in perfect condition for resale, with tags attached and in the original packaging. The Buyer must also include the invoice, or a copy, as well as a written explanation of the reason for return. Upon receipt, CARCER will replace the Goods or refund the purchase price, if they are in perfect condition as described above.
The consumer may, at their discretion, in addition to one of the courts with territorial jurisdiction under the Code of Civil Procedure, bring an action before the court of the place where they resided at the time of the conclusion of the contract or the occurrence of the harmful event.
Warranty of Goods
CARCER warrants the Buyer against all consequences of hidden defects in the goods sold, in accordance with applicable legal provisions.
The Buyer is expressly informed that CARCER is not the producer of the Goods within the meaning of Articles 1386-1 et seq. of the French Civil Code relating to liability for defective products.
Force Majeure
CARCER shall be relieved of all liability in the event of force majeure. In this context, "Force Majeure" means any event or condition that is not reasonably within its control and that prevents, in whole or in part, the performance of its obligations, including, in particular, decisions of a public authority, fires, strikes, shortages of raw materials, loss of export permits, etc.
Processing of Personal Data
CARCER undertakes to comply with the legislation applicable to the protection of personal data in accordance with the French Data Protection Act (Loi Informatique et Libertés).
Partial Invalidity
If one or more provisions of these terms and conditions are held to be invalid or declared as such pursuant to a law, regulation, or final decision of a competent court, the other provisions shall remain in full force and effect.
No Waiver
The failure of either party to enforce any right or provision of these terms and conditions shall not be deemed a waiver of such right or provision.

In the event of any conflict of interpretation between any of the headings preceding the clauses and any of the clauses themselves, the headings shall be deemed null and void.
Applicable Law
These general terms and conditions are governed by French law.
