Terms of Use
ARTICLE 1 - PURPOSE
1.1
The purpose of these general terms and conditions is to define the rights and obligations of the parties in the context of the online sale of Goods (hereinafter the "Goods") and services offered by CARCER to the Buyer (hereinafter "the Buyer").
1.2
All orders imply the Buyer's unreserved acceptance of these General Terms and Conditions of Sale, which prevail over any other document, including any conflicting stipulation on a purchase order or other document issued by the Buyer. These terms and conditions, together with the purchase order and, where applicable, any other agreement between CARCER and the Buyer, constitute the "Contract" for the purposes hereof.
ARTICLE 2 - ORDER
2.1
The Buyer places their order online after consulting the catalogue which is available to them.
2.2
For the order to be validated, the Buyer must accept these terms and conditions by clicking in the designated area on the website. They must also choose the delivery address and method, the billing address, confirm the payment method, and pay online.
2.3
The order will be confirmed by email no later than the time of delivery.
2.4
All orders constitute acceptance of the prices and descriptions of the Goods available for sale.
2.5
In the event that the Goods are unavailable, the Buyer will be informed as soon as possible and will also have the option to cancel their order. The Buyer will then have the choice of requesting either a refund of the sums paid within 30 days of payment, or an exchange of the product.
2.6
For any questions relating to order tracking, the Buyer should call 01.44.02.24.51 (Monday to Friday from 10am to 6pm, cost of a local call).
ARTICLE 3 - PRICE
3.1
CARCER reserves the right to change its prices at any time but undertakes to apply the rates in effect at the time of the order, subject to availability on that date.
3.2
Prices are shown in euros. They do not include delivery charges, which are billed separately and shown before order confirmation. Prices include VAT applicable on the day of the order, and any change in the applicable VAT rate will be automatically reflected in the prices of products in the online store.
3.3
Full payment is due upon ordering. Under no circumstances will any payments be considered as deposits or down payments.
ARTICLE 4 - METHOD OF PAYMENT
4.1
To pay for his order, the Buyer has, at his discretion, the choice of all the payment methods made available to him by CARCER, namely: Visa, MasterCard, CB, and PayPal.
4.2
The Buyer guarantees CARCER that he/she has the necessary authorizations to use the payment method chosen by him/her when validating the order form.
ARTICLE 5 - DELIVERY AND RECEIPT OF GOODS
5.1
No deliveries are made to campsites, hotels, post office boxes, or general delivery addresses. Goods are delivered to the address provided by the Buyer on the order form, which the Buyer is responsible for ensuring is accurate. Any package returned to CARCER due to an incorrect or incomplete delivery address will be reshipped at the Buyer's expense.
5.2
Acceptance: In the event of damage or non-conformity of the delivered Goods, it is the Buyer's responsibility to make all necessary reservations within 14 days of receipt by email to the following address: contact@ikao.fr or in writing to CARCER at the following address: CARCER Ikao lot n142 8 Rue des Gardinoux, 93300 Aubervilliers . Otherwise, the Goods will be deemed to have been accepted in conformity and in perfect condition.
5.3
It is the responsibility of the Buyer wishing to return Goods for an exchange or refund to send them within 14 days of delivery to the following address: CARCER Ikao lot n142 8 Rue des Gardinoux, 93300 Aubervilliers, France . The goods must be unworn, unwashed, and in perfect condition for resale, with tags attached and in the original packaging. The Buyer must also include the invoice (or a copy) and a written explanation of the reason for return. Upon receipt, CARCER will replace the Goods or refund the purchase price if they are in perfect condition as specified.
5.4
The consumer may, at his/her choice, in addition to one of the courts with territorial jurisdiction under the code of civil procedure, bring the matter before the court of the place where he/she resided at the time of the conclusion of the contract or the occurrence of the harmful event.
ARTICLE 6 - GUARANTEE OF GOODS
6.1
CARCER guarantees the Buyer against all consequences of hidden defects in the goods sold in accordance with the applicable legal texts.
6.2
The Buyer is expressly informed that CARCER is not the producer of the Goods within the meaning of Articles 1386-1 et seq. of the Civil Code relating to liability for defective products.
ARTICLE 7 - FORCE MAJEURE
7.1
CARCER will be relieved of all liability in the event of Force Majeure. In this context, "Force Majeure" means any event or condition which is not reasonably within its control and which prevents, in whole or in part, the performance of its obligations, including but not limited to decisions of a public authority, fire, strikes, shortage of raw materials and loss of export permits, etc.
ARTICLE 8 - PROCESSING OF PERSONAL DATA
8.1
CARCER is committed to complying with the legislation applicable to the protection of personal data in accordance with the French Data Protection Act.
ARTICLE 9 - PARTIAL NON-VALIDATION
9.1
If one or more provisions of these general terms and conditions are held to be invalid or declared as such pursuant to a law, regulation or final decision of a competent court, the other provisions shall remain in full force and effect.
ARTICLE 10 - NON-WAIVER
10.1
The failure of either party to enforce any right or provision of these terms and conditions shall not be deemed a waiver of such right or provision.
ARTICLE 11 - TITLE
11.1
In case of any difficulty of interpretation between any of the headings appearing at the beginning of the clauses, and any of the clauses themselves, the headings shall be declared non-existent.
ARTICLE 12 - APPLICABLE LAW
12.1
These terms and conditions are governed by French law.
ARTICLE 13 - CONDITIONS RELATING TO RETURNS AND EXCHANGES
To be eligible for a return, items must be returned in their original condition. Items must not have been worn or washed and must be in a condition suitable for resale.
Returned or exchanged items must include all tags, accessories, and instruction manuals. No refunds or exchanges will be issued for incomplete, damaged, or soiled items.
Exchanges:
Please return the item(s) to us following the return procedure, as explained in the previous section.
Please indicate on the return form the item(s) to be exchanged, the reason for the exchange, and the color and size of the new item requested. Then, please include the completed return form inside the package containing the returned item.
The availability of the requested replacement item cannot be guaranteed. Your replacement order will be sent using the same delivery method as your original order. Shipping costs for the replacement order will be covered by Ikao Paris.
Once the exchange process is complete, you will receive an email notification.
Refunds:
We will refund the original price paid for the returned item.
The total amount of the return will be credited to the buyer's original payment method. The buyer's original bank card will be credited upon processing of the returned items, and the credit will appear on the customer's next bank statement.
Original delivery charges are non-refundable, except in cases of cancellations by the seller.
Once the refund process is complete, you will receive an email notification.
